Fatwa of Sheikh at-Tartousi on the Emir of the Caucasus Emirate Dokku Abu Usman and on discords around him

Question:

 

May peace be unto you and so the mercy of Allah and His blessing, oh Sheikh Abu Baseer at-Tartousi!

 

We recently phoned you and asked you to say a word about the Mujahideen and for the Mujahideen in the Caucasus, as you remember.

 

We have witnessed some events, and the Mujahideen need a support from people of knowledge (ahl ilm), and we know that you are for the Mujahideen, and together with them ...

 

And as you earlier said about Dokku Umarov, he, Insha'Allah, is the legitimate Emir of the Caucasus Emirate...

 

We have already published (translated) the fatwa you sent to us by e-mail, and we have already distributed your fatwa on many Islamic websites, and, Insha'Allah, the Emir Dokku Umarov also read your fatwa.

 

This information has been conveyed to the leadership of the Mujahideen of the Caucasus, and, Insha'Allah, they are very glad of your support, may Allah reward you in goodness!!

 

And as we have already told you earlier, some events happened in the Caucasus.

 

The Emir of the Dagestan province, and he was also the Qadi, or the Supreme Judge of the Caucasus Emirate, Seyfullah martyred, Insha'Allah (and before that, he explained to emirs, or commanders, of the Mujahideen of the Caucasus that Dokku Umarov is a legitimate ruler of Muslims and that everybody must obey to him, and that the arguments of those who rejected their subordination to him cannot be accepted by the Sharia).

 

However, several emirs still do not obey (are not subordinated) to Emir Dokku Umarov. Are they allowed at all to disobey Dokku Umarov?

 

A fitna, or discord, occurred as a result of this, - not a big fitna, but nevertheless, this fitna may further deepen the split (and the enemies of the Mujahideen from among nationalists and democrats are trying take advantage of it).

 

And there is (among the Mujahideen) one brother from among Arab volunteers, and he's one of those who do not obey Dokku Umarov, and now the question is: are they allowed to withdraw their subordination to him and not to obey the Emir Dokku Umarov?

 

And in addition to that, they say that he made mistakes, for example, in tactics - (manhadj) or in tactics of waging the Jihad, or for example, he does some things, for which there are different opinions among scholars. For example, Sheikh Hammoud bin Uqla Ash-Shuaibi (may Allah have mercy on him) said that what, for example, Sheikh Osama bin Laden did in 2001 had been allowed by Sheikh (Ash-Shuaibi), and some scholars said that this is allowed, and some say that it is not.

 

That is that there are events in which there are disagreements about such things, and that concerns, as you heard, some events in Moscow in which there was a self-sacrifice (according to istishhad - martyrdom operations), and in this operation, about 40 people were killed, and there were women among the killed. And for example, they also say that these were mistakes, or something else like that, and so on...

 

And those few emirs who do not obey Dokku Umarov say: we do not want to obey to you, and so on ... And now the very essence of the question is:

 

"Are those few emirs allowed not to obey to Emir Dokku Umarov? At the same time, all other emirs and the Mujahideen all over the Caucasus Emirate say: "You are our Emir and we pledged allegiance to you, and we will adhere to our allegiance".

 

Therefore, we want to hear a hukm from you about this situation, and here I end my question, May Allah reward you in goodness!"

May peace, mercy, and blessings of Allah be with you!

 

May Allah reward you in goodness, may Allah reward you in goodness, brother - May Allah reward you in goodness.

 

This is such a subject and a question that it is difficult to judge quickly with a word or a few phrases on the phone only, not knowing exactly what causes these or other people to speak or to do so.

 

But first, we say: Sheikh Mujahid Dokku Abu Usman is the Emir al-Mujahideen (may Allah preserve him) and subordination and obedience to him are obligatory.

 

You cannot rebel against him because of disagreements in some issues in certain situations, in which there is ijtihad and in which there is a choice.

 

And if we are to justify secession and rebellion against emirs of jihad because of small disagreements or due to small discrepancies in views, then it will be no consolidation of Muslims, one group will turn into two groups and the two will turn into four, and the four will turn into ten, etc. .

 

And this is against what is commanded to us by the Sharia. Allah said: "Hold firmly to the rope of Allah all together and do not be divided".

 

This is something that I can answer now. I do not like to indulge in arguments, like judging in such large matters, because it has its own requirements and its constituent parts, in particular, it should be listened what the opponents say.

 

But in general, I strongly warn against disagreements, disputes, enmity and hatred. Allah said: "And do not dispute and [thus] lose courage, and [then] your strength would depart", "Hold firmly to the rope of Allah all together, and do not become divided".

 

Prophet Muhammad (pbuh) said: "Allah's hand is with the Jamaat (Assembly)".

 

And if there is a dispute or disagreements between the brothers, and especially, among the Mujahideen, it returns them to weakness and leads to the domination of the enemies over them. (This is dangerous, and it is necessary that this is understood by those who say that they do not subordinate to the Emir).

 

Minor disagreements and minor contradictions in opinion cannot justify separation, discrepancy and rebellion against the Emir of the Mujahideen Abu Usman, may Allah preserve him.

 

This is what I can now answer you quickly, but in personal matters and personal problems (mutual relations), and in problems concerning some issues, it's impossible to start debates on the phone, with conversation listened by enemies and friends.

 

Do not think that my words of mine are listened only by you, brother. This conversation, which I am now carrying on is being listened by the whole world, and it is enough for me at present:

 

Are my words clear? It is clear. Praise to Allah.
